No Purchase or Payment of any kind is necessary to Enter or Win this Sweepstakes. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. "#89 Rescue Tool – Eights and Nines" Sweepstakes ("Sweepstakes") will begin at 10:00 AM Eastern Time ("ET") on June 8, 2009 and end at 8:00 AM ET on July 24, 2009 ("Sweepstakes Period"). Sweepstakes is sponsored by Channellock Inc., 1306 South Main Street, Meadville, PA 16335, (the "Sponsor"), who is solely responsible for all aspects of this Sweepstakes.
Eligibility: Sweepstakes is open to all legal residents of the United States and D.C. (except those that reside in states of Alaska and Hawaii), 18 years of age or older, as of June 8, 2009. Employees, officers and directors of the Sponsor (Channellock Inc.), affiliates, subsidiaries, agents, advertising and promotion agencies, (collectively including Sponsor, "Sweepstakes Entities") their immediate family members (parents, children, siblings, spouses) and persons living in the same household (whether related or not), are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry will be deemed ineligible and any prize awarded shall be revoked. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed or restricted by law.
How to Enter: A qualified person may enter by visiting www.theRescueTool.com, clicking on the "#89 Rescue Tool – Eights and Nines" Sweepstakes graphic and completing the online Sweepstakes registration form and survey questions. The information required on the entry form: Name, Address (includes City, State, and Zip Code), Date of Birth, Phone Number, E-mail address. All entries must be received by 8:00am ET on July 24, 2009.
Only one entry per person per e-mail address or per mailing address is allowed for each drawing during the sweepstakes period. Each drawing throughout the Sweepstakes period includes entries beginning on Monday (at 12:00:00 AM ET) thru Sunday (at 11:59:59 PM ET); only exception is final week which is thru Friday (at 8:00 AM ET). The Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator. All entries become the property of the Sponsor and may not be acknowledged or returned.
Internet Limitations of Liability: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Sweepstakes Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Grand Prize: There will be One (1) Grand Prize, One (1) First Prize winner, and Seven (7) Second Prize winners. The Grand Prize winner will receive a 4 day/ 3 night trip for two (2) to the NFL Hall of Fame Enshrinement Ceremony and Game in Canton, Ohio ("Location"). The Grand Prize package (the "Package") will include: 1) roundtrip airfare for two (2) people (Fees, taxes, surcharges, and/or service charges are the responsibility of the passenger); if Winner resides within 150 miles of Location, Sponsor reserves the right to substitute ground transportation, 2) Three (3) night Hotel Accommodations (Aug. 7-9, 2009) at the Holiday Inn Cleveland South (based on double occupancy), 3) Two days admission for two (2) to the Football Hall of Fame (good any day Aug. 7-10), 4) Two (2) reserved seats to the Parade on Cleveland Ave., 5) Admission for two (2) to the Enshrinement Celebration Fan Party, 6) Admission for two (2) to the Enshrinement Ceremony, 7) Admission for two (2) to the Fan Appreciation Tailgate Party, and 8) Two (2) tickets to the Hall of Fame game (Buffalo Bills vs. Tennessee Titans) on August 9, 2009. The Grand Prize winner and travel companion must execute liability/publicity releases prior to issuance of travel documents as set forth in these rules. Airline carrier and hotel regulations and conditions apply. The Sponsor (or Sponsor's designee), in its sole discretion, will determine transportation and lodging providers, which are subject to change per the Sponsor, at its sole discretion. Travel and accommodations are subject to capacity controls, availability, blackout dates and other restrictions. Winner and his/her guests will be solely responsible for all other expenses not specifically set forth herein including but not limited to round trip transportation between the winner's residence and any airport of origin, taxes, airline fees, baggage charges, gratuities, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone, in-room services, tips and any other incidentals. The Grand Prize will be deemed awarded upon the winner's receipt of the Package containing the tickets, certificates and vouchers. Sponsor will not replace any lost, mutilated, or stolen travel vouchers, tickets or certificates. The Approximate Retail Value ("ARV") of the Grand Prize is $3,100 which will vary depending upon points of departure and destination and seasonal fluctuation of hotel rates and airfares. An IRS 1099 form will be filed in the name of the winner for the ARV of the prize. The travel and accommodations can not exceed the maximum allowable prize amount of $3,100 and any difference between stated ARV and actual value of Grand Prize will not be awarded. The trip must be completed and the vouchers redeemed from August 7 – August 10, 2009 or the prize will be forfeited.
The First Prize winner will receive a customized #89 Rescue Tool for the winner and the opportunity to select a firehouse of their choice to donate twenty-five (25) #89 Rescue Tools (Winner to provide address of firehouse; Agency to send award); ARV of the prize is $60. Each Second Prize winner (drawn weekly) will receive a customized #89 Rescue Tool); ARV of the prize is $60. The Total Prize pool is $ 2,580.
By accepting any of the aforementioned prizes, prize winners agree to release Sweepstakes Entities from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Sweepstakes or for damages of any kind caused by any prize or resulting from acceptance, possession, or use or misuse or failure to use any prize awarded. Sponsor has not made any warranty, representation or guarantee, expressed or implied, in fact or in law, with respect to any prize and specifically disclaims all such warranties, including, without limitation, any warranty of merchantability or fitness for a particular purpose. The prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND. Prizes are not exchangeable, transferable, or redeemable for cash. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value. Limit one prize per person/family/household email or mailing address during the Sweepstakes period.
Drawing and Notification: The Grand and First Prize winners will be selected, from among all eligible entries received, in a random drawing on or about July 24, 2009. The Second Prize winners will be randomly drawn on the following dates: 6/15/09, 6/22/09. 6/29/09, 7/6/09, 7/13/09, 7/20/09 and 7/24/09. The drawings will be completed by The American Sweepstakes & Promotion Co., an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. All Prize winners will be notified by telephone and/or mail, or other home delivery service.
Prize Conditions: Prize winners are solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. If a potential winner cannot be contacted within three (3) days, an alternate winner will be selected. Return of any prize notification as undeliverable will result in disqualification and an alternate winner will be selected. The winner's entry and acceptance of the prize offered constitutes permission (except where prohibited by law or Sponsor's Privacy Policy) for the Sponsor to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Terms & Conditions: This Sweepstakes is subject to all applicable federal, state, and local laws. The Grand Prize winner will be required to complete and return (within 5 days of written notification) an Affidavit of Eligibility and Liability/Publicity Release. Failure to comply with the 5-day time period may result in disqualification. Each Travel Companion of the Grand Prize winner(s) will be required to complete a Travel Companion Waiver form. If the Grand Prize winner or travel companion is a minor (as determined by the laws in the state in which the individual resides), a parent or legal guardian must sign and return the release and accompany the minor on trip. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Entrants also consent to the use of the personal data they submit to be used solely by the sponsor and affiliated partners for marketing purposes, statistical analysis, or customer relations. This information will never be sold or shared with third parties and all entrants will be given the opportunity to opt-out at any time. All Prize winners and all entrants also agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of prize offered, or participation in this Sweepstakes. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law.
